The Real Estate (Regulation and Development) Act, 2016 is an Act of the Parliament of India which seeks to protect home-buyers as well as help boost investments in the real estate industry. The bill was passed by the Rajya Sabha on 10 March 2016 and by the Lok Sabha on 15 March 2016. The Act came into force from 1 May 2016 with 69 of 92 sections notified.
By a Gazette notification dated 21 November 2016, Ministry of Housing and Urban Affairs constituted an interim Real Estate Regulatory Authority for the National Capital Territory of Delhi and appointed the Vice Chairman, Delhi Development Authority as the Regulation Authority. Accordingly, Shri Udai Pratap Singh held this position from 21 November 2016 to 30 September 2018; and, Shri Tarun Kapoor held the position from 1st October 2018 to 14th November 2018.
The Real Estate (Regulation and Development) Act received the assent of the President on 25 March 2016 and provisions of the Act came into force progressively thereafter. In exercise of powers conferred upon Hon’ble Lieutenant Governor of Delhi as the ‘Appropriate Government’, a notification No.221 dated 14th November 2018 was published under Section 20 of Real Estate (Regulation and Development) Act 2016 to establish the Real Estate Regulatory Authority for the National Capital Territory of Delhi on a regular basis.
